Nursing Homes and mental hospitals

hi there,

i have a very serious question and need a real answer. my step grandmother is living with my mom, and her name is on the house. we are going to get her to sign a quit claim deed and she needs attention from a nursing home but they won't take her if she has assets and won't take her for five years after she signs. we are possibly thinking about a mental hospital. will the mental hospital come after us for the house? we are not blood related but my step grandmother son was married to my mom but unfortunately died from heart failure a couple years ago. would we be responsible for her? she has a daughter and grandchildren. what should i do?

Hi coff,

The mental hospital can come after you and can also place lien on the property. Moreover, if she quitclaims the property to you and then you admit her in a mental hospital, it can render the deed invalid as one can argue that when the deed was signed the grantor was mentally unstable. Thus the deed can be proved to be void. You better consult a legal expert in this regard.
