I am going through a divorce and one of the terms states that I take my spouses name off of the mortgage (assumption) I am in the prcess of doing this but my mortgage co states I need to remove my wifes name from the deed and title to the property. My wife is wiilling to relinquish her ownership (as stated in our divorce papers). What is the correct way to do that. I understand that there are some forms to fill out. Can these be bought at a store or do they have to come from an attorney? I just want to know the correct process so that we can proceed with the finalo divorce. Thank You

In order to remove your wife's name from the property deed, you will have to ask her to sign a quitclaim deed in your favor. You can contact an attorney and he can draft the deed for you. Once your wife fills out the deed, you can notarize and record it at the county recorder's office. Then you can show the property deed to the mortgage company and ask for an assumption.
