quit claims deed

I am going through a divorce and my husband has filed complete bankruptcy but I have not. Should he still have to sign a quit claims deed for me to be able to take over the mortgage?

As he has already filed bankruptcy, he won't be able to sign a quitclaim deed now in order to transfer the property to you. If he does so, it will be considered as fraudulent. He will be able to transfer the property to you after the bankruptcy is discharged.
