My husbamand and I own 2 properties in both names and wish to put 1 in just my name and 1 in just his name. How do we do this. We have a mortgage on both.
you file a quit claim deed to remove the owner you want removed. however, in some states a marriage entitles a spoues to ownership in a property even if they are not on the deed to the home.

if you only want to transfer the ownership of the property, then you will have to sign a quitclaim deed. in case you need to transfer the mortgage also, you will have to refinance the loan.
