quitclaim deed

my brother is deceased in 2010, no will , three adult children, i wish to complete the morgage and own the house, is a quit claim deed the way to proceed, all three agree for me to complete morgage and own the property
If there is no will, the home should have gone to probate court. Was there a probate to determine who get the home? What type of estate did he hold? Was it to be passed on to his heirs?

Welcome to forums!

You will have to file an affidavit of heirship at the county recorder's office in order to get the property transferred in your name. A quitclaim deed won't be of any help in this case.

there was no probate court and no excutor of estste The house is morgaged and in the state of MO. All three childern are of legal age and agree for me to complete the morgage and own the property

in that case, the children can file an affidavit of heirship and get the property transferred in their names. as far as the mortgage is concerned, they can refinance it in their names.
