quit claim deed

my husband is currently under a chapter 13 bankruptcy . he filed for a divorce .the mortgage is in his name but the deed is in both of our names.i've just filed for a chapter 7 can i get him to quit deed the house into my name and have the house refinanced into my name if i'm in bankruptcy?

Responsibilty and ownership rights in the home is different from rights and responsibilities for the loan. Anyone who signed the loan note is responsible for the monetary debt.

Hi Tangela,

I completely agree what Sussane has said. If you're in bankruptcy, then none of you can transfer the property or refinance the mortgage. In order to take any decision regarding the property and the mortgage, you will have to wait till the bankruptcy filing gets discharged.
