my x-husband passed away last month and his name is listed on several properties with their aunt & uncle. my x-husbands father had a will that states the property will go to heirs. his children my children with my x-husband. the sister wants my children to sign a quit claim deed to put their names on all the properties - that what she told them and this would remove their dead father's name off the properties - what should they do?
all properties are in colorado and my x-husband did not have a will.

In order to remove their dead father's name from the property deed, the children will have to file an affidavit of heirship at the county recorder's office. If your deceased ex-husband has left a will, then you and your children will have to probate the will. Once the probate is complete, the property will be divided as per the will.
