Quit claim deed in a marriage

Posted on: 17th Sep, 2008 11:37 am
my husband and i just put an offer on a house and waiting for it to close. due to some irrational thought in his mind that i will someday request a divorce, he is refusing to put my name on the title of the house and is forcing me to sign a quit claim deed removing my interests.

my question is - does signing the quit claim mean that property will not be divided equally among us in case of a divorce? i live in washington state where community property for marriage couples is the norm.

also, we got married overseas - does that make a difference?

in other words, do i have a right to half the house if i file for a divorce? he is very controlling and feels that so long as a woman has a roof over her head, she does not need to own any real estate. furthermore, i help him out in his business and do all the billing and take care of our two daughters. we have been married for 7 years now.

anxiously awaiting your response!
Hi lookingin!

According to the laws, Washington is a community property state and if you are paying a certain amount of mortgage for the house, you will have a right over certain portions of the property. So if your husband decides to sell off the house, you can claim certain amount of the payments.

However, if you quitclaim the property in his name, you will not be able to claim your share in the property. It will remain in the name of your husband. Marrying overseas will not make any difference in this case.

Hi lookingin!

Washington is a community property state and according to the laws you are entitled to get certain portions of the property if you pay a part of the mortgage. However if you sign a quitclaim, then you will lose your interest in the property and will not be entitled to get anything.

Thanks,

Jerry
