my brother had bought a house with his girlfriend, but he is thinking of doing a quit claim to his girlfriend because she has been making the monthly payments. my concerns as well as my families are....she has major child support arrears and horrible credit...just simply horrible. my question is... can child support put a lien on the house if a quit claim deed was made to her? and will it be on her credit report? my family and i are really concerned for my brother. we don't want him to do a quit claim and loses his house.
Your brother can only quit claim his interest in the home to his girlfriend but cannot be removed from the loan via the quit claim deed. I don't know the location in which his child support is in arrears but there are about 30 or 31 states that participate in the Child Support Lien Network.

In order to place a lien on a property, you will have to file a petition in the court. If the court gives a judgment in your favor, you'll be able to place a lien. However, if the non-custodian spouse is unable to pay the child support, then it's common to garnish wages rather than place a lien on the property.
