Quit Claim Deed/Credit Card Debt

i lost my job a few months ago, and it has been difficult to keep up with mortgage payments and credit card payments.

can i take my name off the deed if the mortgage is in my husband's name as well as mine?

i am afraid that if i cannot pay the credit cards that are in my name the cc companies will put a lien against me and we will not be able to sell or refinance our home in the future.

i do not want to file bankruptcy. can the cc companies place a lien against my husband for my debt for the credit cards that are in my name only??

any advice would be so appreciated!!
Hi Debi,

You can remove your name from the property deed though your name is mentioned on the mortgage. However, there are chances that the lender will ask your husband to refinance the loan in his name after the change in property ownership.

Once your name is removed from the property, the credit card companies will not be able to place a lien on that property.

Can the cc companies place a judgment against my husband for the cc's that are in my name only?

Hi Debi,

If the credit cards are only in your name, then the credit card company will not be able to place a judgment against your husband.

Is there any chance you could borrow this many from someone? (family/friend/etc?) You could offer them half of the interest rate and they should still be happy (o course if you can pay it off)
because refinancing means you will lose more money in the end, so if you can avoid it, by all means do.
