my dad & his partners name are both on the mortgage. she has recently passed away. should my dad remove her name from their banking accounts & do a quit claim deed in the event of future claims on the property & accounts. these credit cards & debts are in her name only.
Your father will have to file an affidavit of heirship at the county recorder's office and remove his partner from the property deed. Then he can take steps to remove his partner from the bank accounts as well. This will help him save the property as well as the bank accounts from the creditors.
