Quit Claim and debt

Posted on: 21st Mar, 2010 02:07 pm
There is no mortgage involved in a house he owns with his former wife, and my fiance wishes to sign over his portion of the house to his former wife. In doing so, he wants to be absolved of all financial debt that had incurred while married and was stated in the divorce agreement would be paid off from the house sale proceeds. Does a quit claim allow for this or can it be added?
Hi rein,

As there is no mortgage on the property, then your fiance is not responsible for any financial obligation in regards to that property. In that case, he can simply sign a quit claim deed and transfer the property to his former wife. Then she needs to notarize and record the deed at the county recorder's office.
