I was married in 09 to a man who has 4 adult children. His 1st wife passed away in 07 and her name is still on the property. Can a quit calim deed remove her name from the property? My concern is that my husband is a OTR truck driver and should something happen to him will his children get contol of the house? We are going to get a will done but just haven't gotten to it yet as he is only home a couple of days every other week.
welcome winstonronipony,
a quit claim deed will not be able to remove the deceased wife's name from the property deed. your husband will have to file an affidavit of heirship and get the property transferred in his name. then he can sign a quit claim deed and add your name to the property deed. the adult children will be considered as heirs and thus, they will have rights to that property.
