Quit Deed

in 1982 my grandfather was having surgery and the day of it singed a quit claim deed for his property listing my uncle as the one whom the property would be given to and it stated he omitted his other two children from the property. the next day my grandfather passed away. only until recently when my uncle passed away was it discovered that the property was never legal changed to his name and was actually still listed as my grandfather. my dad would like to try to get this property. my uncle had a will leaving his property to his daughter, but does he have a right with the fact that it was not in his name? if you need more detail please ask.

If the property is still listed in your grandfather's name, then your uncle will not be able to transfer that property solely to his daughter. Your father and his other siblings will also be able to claim their share from the property. I would suggest your father to contact a real estate attorney and check out whether or not he would be able to claim his share of the property.

W actually did contact a lawyer, but they wanted 10K just to look into it. We were not willing to shell out 10K without knowing what the chances were of getting the property. I will share your info with my dad however Thanks for your response.
