What if both spouses are on the deed but only one spouse is on the mortgage. What kind of impact would this have in divorce from a liability standpoint?
That needs to decided in the court, I guess!
Hi dtaylor,
If both the spouses are on the property deed, then both of them are owners of the property. Both of them can claim a portion of the property during the divorce. Both the spouses will have to decide who would receive the property in divorce and accordingly apply to the court.
