QUIT CLAIM DEED

I am divorced and I quit claim deeded the house to my x husband, my attorney never told me in order for me to get off the mortgage he would have to refiance the house. He NEVER pays the mortgage on time and has now ruined my credit. I am considering filing a chpater 7 due to this to start over. If I do this how will this affect him? Will he be forced to refianace or will the bank foreclose on the property. What are my options at this point?

if you want to save the property, you can ask your ex-husband to deed back the property to you. you can pay off the default dues and refinance the loan in your name. the trustee has the rights to sell off the property in order to pay off the creditors. i guess your ex-husband is not jointly filing bankruptcy with you. in that case, his credit report will not get affected due your bankruptcy filing.
