Quit Claim Deed Fees - Divorce

Posted on: 02nd Apr, 2010 10:15 am
i am recently divorced and my ex is keeping the house. i am preparing a quit claim deed form and am confused about the fees associated with filing it. in cases of divorce (i'm in florida), do i have to pay doc stamp fees? what do these apply to - original purchase price of home, amount currently owed, ???

any advice would be appreciated!
Hi blueeyedgirl,

As you are transferring the property, you would be liable for paying doc stamp fees. You need to list the original purchase price of the property in order to check out whether or not you would be liable for capital gains taxes. I would suggest you to have a word with your real estate attorney and take his opinion in this regard.

blue i don't believe your tax liability will be anything major. you're not selling the home, but are transferring your ownership interest. there won't be capital gains in a situation like that. now, this is strictly opinion, so as adonis recommended, you'll probably want to discuss this with your attorney also.
