is a quit claim deed valid if not filed with the county office?...my ex has a quit claim deed that was filled out approx. 2 years ago. is it still valid if it's not filed with the county. also, can she still file it anytime? or can i have her removed? thank you
Hi groundcontrol,
The quitclaim deed is not valid until it is recorded at the county recorder's office. Yes, if she wants she can record the deed now at the county recorder's office. If she has not filed the deed, then the question of her removal from the deed does not arise. But if she has filed the deed, then in order to remove her name, she will have to sign a quitclaim deed.
Thanks
