quit claim fraud

My divorce awarded me property that I had owned half of and my ex-husband had owned half. He knew I was going to be awarded this . I found out that the portion that was awarded to me had been quitclaimed to my ex-husbands, ex-wife several months ago to defraud me. Now what do I do?

In my opinion, you should take some legal help to resolve the issue. You should contact a real estate attorney and check out what steps you need to take in this regard. If there has been a fraudulent transfer, then you will be able to sue him and reverse the deed.

thanks for the reply Sussane. My current attorney seems to think that I will need to sue the ex-wife for my property now. The ex-husband just gets off Scott-free. He is in Iraq. He also had allotment checks based on my mortgage going to his ex-wife also. I have my life savings tied up in this property. I owned 50% of this property before I ever married my ex- and he owned the other 50%. He decided to go back with his ex-wife and they knew I was going to be awarded his half of the property because I brought it out of foreclosure and paid a lot into it. The ex-husband and his ex-wife conspired to defraud me. Now I won't even be able to sell my half, so I'm totally out!

louise, i think your current attorney needs to stop "thinking" and get moving on an action. if the best advice he can give you is that he thinks you will need to sue her, then he's not giving you much advice at all. he needs to be your advocate, working on your behalf in order to get back what you had before this fraudulent activity.

you may very well need a new lawyer.

my current attorney took over for my attorney who got terminally ill and couldn't finish my divorce proceedings. However, he told me today that he needed $4,000.00 up front to continue helping me on this case. I'm getting a second opinion on Monday from another attorney. Thanks for your advice... I think I will use it.

oh man...please don't tell your current lawyer that it was me who said you might need to find someone else. i don't need any more enemies!

I certainly wouldn't tell him. I merely want a second opinion. I think he was a little extravagant in his asking price... but then what would I know about attorney's fees. I'm just emotionally upset that anything like this could take place and there seems to be nothing in place to prevent it.
