i just became legally divorced. under the terms of the court, my ex has to buy my share of the house since he is keeping the marital property. if he doesn't get a loan to refinance the home within 90 days, he has to sell the house. my ex claims he has been approved for a loan and wants me to quitclaim the house over to him. if he does not have a loan, we are to sell the marital property. am i safe in quitclaiming the deed over whether he has a loan of not?

You can ask him to show the mortgage commitment letter that the lender has given him. If he is able to show you the letter, it means that he will get the mortgage to refinance the loan. At the time of the closing of the loan, you can sign the quitclaim deed in his favor.

Thank you Sussane for your reply. I am in OHIO and my ex refuses to show me anything. I no longer have my atty and I didn't want to call him for just one question. My Ex is telling me he needs it for the loan officer. Any more ideas?

Though your husband has said that he needs the deed for the purpose of the loan, it'll be better if you sign the deed at the time of the closing.
