My mom is in a nursing home and she owns her house. Was wondering if we did a quit claim so that we could add my brother and myself to the deed? Can the nursing home still end up taking our homeplace if we do this?

As far as I know, your mother cannot transfer the home to you and your brother in this situation. The transfer could be considered as a means to avoid paying the nursing home and thus, it could be treated as invalid. However, she can add you and your brother to the property deed. But the nursing home will still be able to come after the home.

Rather than going for a quit claim deed, it would be better if your mother signs a ladybird deed and transfers the property to you and your brother. Thus, the property will be considered as an exempt asset for Medicaid eligibility until a spouse or a relative occupies it when your mother is not around.
