my sister in law is not sure why a quit claim deed was signed by her husband (my brother, now deceased) regarding property in wyoming. he lived on this property with our father and his wife, and he did a majority of the building and repairs. he had not told his wife (my sister in-law) about this form, and there was a falling out regarding the relationship between her and my father & wife. she only heard about this form from my other brother and is being offered $3000.00 from our father to leave it all behind (they have kicked her out of the house she shared with my brother, her husband). what, if any, legal rights would a quit claim deed give to her? my brother, her husband, signed the form before he met her, so i do not think her name would be on the form. i was told he signed some form with an attorney to prevent them (my father & his wife) from giving the property to the grand-children of my father's wife only. now that my brother is deceased what does that offer for his wife, my sister-in-law, if anything regarding the property? is this deed also used to prevent others from getting property that he evidently felt should not go solely to them? is this deed used to make sure one has a say in what happens to property they feel they have a right to?
Hi iwill,
If your deceased brother has signed a quitclaim deed and transferred the property to someone else, then his wife (your sister-in-law) won't have any rights to the property. The person to whom the property was transferred would be considered as the owner of the property. The owner of the property can now ask your sister-in-law to leave the property.
