removing someone from a deed

Posted on: 21st Oct, 2008 05:03 am
I have a friend who is bedridden and does not have full use of her mental facilities.. Her nurses aid told her to put her name on the deed of the house (house is paid for no mortgage)
She told her that when she dies that it will be easier for her to have the home transfered over into her name and avoid probate.
Make a long sotry short...there was a quit claim done by an atty adding her name the aide on the home..now there has been abuse to the homeowner by the aide and the aide was fired....however she is still on the home. My friend the homeowner wishes to remover her from her home..
can a simple quit claim be done removing her from any ties to the home?
I know that this person the aide has taken advantage of my friend and has done horrible things to her.
What do you suggest...I guess the question that I am asking is can she be removed from the home deed simply by a quit claim or does the homeowner have to prove that she the aide did this to her under diress and was basically hood winked?

Thanks...babbs
Hi justbabbs!

Your friend has to go in for a reverse quitclaim. If your friend's aide is ready to sign a reverse quitclaim, then it will be easier for the homeowner to remove her name from the title. If not, then your friend will have to take some legal help and challenge the aide in the court. Here your friend will have to prove that the aide made her sign the quitclaim deed under a false pretext.

Thanks
