Can my bro dispute my mom quitclaiming her condo to me?

Posted on: 24th Aug, 2009 12:18 am
My mother quitclaimed me her condo 3 years ago and gave it to me for caring for her during her fight with cancer which is almost over. My other siblings have no problem with the situation except my money hungry brother . I heard that he is going to challenge/dispute the quitclaim. Can somebody tell me if this is possible to do or if it goes to probate? Tha condo is worth about 85k and in Ohio. Thanks to anyone who can help.
If the condo has been quitclaimed to you, then it will not go into probate. You will be considered the owner of the property. As far as disputing the quitclaim deed is concerned, your brother can do that. In my opinion, you should contact your attorney and take the required steps.

if he has raised his voice in protest, then he has already disputed the quit claiming of the property to you. can he attempt to take legal action? i would think the answer to that is yes. can he win? that answer would be "maybe."
