situation: impending divorce; desire to take over title of home (currently under both names) and to continue same mortgage but changing to be under my name only (currently under both names). in what order do i carry out these tasks? ( divorce decree; quitclaim and novation)

to take over the title of the home, you will have to ask your spouse to sign a quitclaim deed and give away the property interests to you. after your spouse quitclaims the property, you should notarize that in the county recorder's office. once this is done, you can either refinance and take over the mortgage in your name or go through the process of novation.
