my brother got divorced in 2006, but his ex-wife is still on the deed of the house. she is not on the mortgage. in the divorce decree it states that he gets the property but we need to get her name removed. i read all about his quit claim deed info, but problem is that we do not know the lcoation of my ex sister-in-law to fill one out. do we just now fill out a general warranty deed along with the original divorce decree to the courthouse to have it filed.
Hi Laura!

Welcome to forums!

I don't think your brother will be able to use a warranty deed as there is a mortgage on the property. He will have to ask his ex-wife to sign a quit claim deed in order to remove her name from the property deed. You need to take the opinion of your attorney in his regard as you're unable to trace her.

Feel free to ask if you've further queries.
