divorce rights after quit claim

Posted on: 17th Feb, 2009 02:04 pm
Before my dad died, he did a quit claim to my 2 brothers and myself. Now my one brother may be getting a divorce. If he quit claims to the 2 of us taking his name off, would his wife be able to go for any interest in the property? Thanks
Hi Angie,

Since your dad quitclaimed the property to you and your 2 brothers, you three now are the legal owners. Now if one of your brothers wants to quitclaim his share of interest in the property to you through a quit claim deed, his wife cannot claim any interest in the property, simply because she's got nothing to do with the transfer of a property the title of which doesn't even bear her name.
