divorce - quit claim deed or special warranty deed?

Posted on: 20th Nov, 2009 04:22 pm
i have been divorced for a year and a half and am trying to get my loan modified. i was told to get a quit claim deed from my ex. a friend whom works at a law firm stated it would be better to have a special warranty deed. which would be the best way to go? i can't afford an attorney or i would have to begin with.
Hi rcamiller!

Welcome to forums!

As there is a mortgage on the property, I don't think you will be able to use a special warranty deed to transfer the property in your name. You'll have to use a quitclaim deed and get the property transferred in your name.

Feel free to ask if you've further queries.
