MY HUSBAND AND I ARE GETTING A DIVORCE I WILL GET THE HOUSE AFTER PAYING OFF HIS INTREST. HE WANTS TO DO A QUITCLAIM .THE HOUSE IS PAY OFF. I WANT IT TO BE IN MY NAME ONLY .IS THIS THE WAY TO GO?
you've got to wait until you either sign an agreement or a court orders that you have possession of the home. your husband's name can be removed from the deed via quit claim deed.

we have all the paper work done and stamped all that is needed is to call for a court date which you can get the next day.my husband has put money on a house and i have sign a quitclaim so i will not be on the deed of the new house.i did not sign the loan papers on the new house.i will give him his interest money on his day of signing the contract .i want him to sign the quitclaim at that time.ordo i wait until we are divorce

Hi SUZANNE,

You can ask him to sign the quitclaim deed as soon as you pay him off his interest in the property. However, in my opinion, you should contact your divorce lawyer in this case and take his opinion regarding this issue.

if my husband signs a quitclaim will i have to pay taxes on it
