Am I still entitled to equity?

Posted on: 22nd Jun, 2009 10:18 am
i have quit claimed my house to my ex-husband. in our divorce papers he stated that he will re-finance house and split the equity with me. does the quit claim deed affect that? can it negate the divorce papers and he with hold money from me?
i would certainly hope that you negotiated this settlement with the assistance your lawyer and the consent/approval of the court. as a general rule, you'd not want to quit claim your rights to the property unless you had money in your hand, just as he wouldn't hand you the money without a quit claim deed in his hand.

you had better go back and review your settlement.

shall we take it for granted that you are an owner of the home, though? in that case, i'd think you'll be able to count on compensation for your equity position, but that's really something you're going to have to discuss with your divorce lawyer. the court will be the ultimate judge of whether there's any money to share, i believe.
