Divorce and quitclaim deed

My ex-wife claimed all mortgage interest and property taxes for her 2009 taxes. She filed online. I found this out when filing my taxes. We both lived at the house for all of 2009. I signed a quit claim deed on Jan. 12, 2010 and she refinanced the house on Jan. 14, 2010. The original loan for the house was in my name only. The mail from the bank was addressed solely to me. She was however on the deed. In our divorce decree, there is no mention of who could/should claim the mortgage interest and property taxes. I expected to at least split the interest and taxes, however she had other plans. Does the quitclaim deed I signed take away my rights to claim any interest or taxes on the property for 2009? The IRS says that she shouldn't have claimed this money and said I should refile claiming this money and to let an investigation take place. I have contacted a lawyer to help me make sense of this. Please help! ALSO-I have been told that I could claim ALL of this amount, however despite what she did, I'm only wanting to claim half because that is only fair (we shared a bank account for all of 2009).

You signed the quit claim deed in 2010 and you had paid the mortgage interests in 2009. So you have the rights to claim the mortgage interest on your taxes. I would suggest you to follow what the IRS has said. It's good that you have contacted a lawyer in this regard. You should refile your claim for the money.
