My father recently passed away in California with no will. He purchased a home in Las Vegas last year cash and had my stepmother signed a quit claim. I believe she actually sold her rights to him also. He has 4 children from previoius marriages. Does the property have to go through probate and is she entitled to any portion of the house?
Hi jesnik!
Welcome to forums!
As the wife's name is not mentioned on the property deed, then she doesn't have any rights to the property now. As their is no will, all the heirs have equal rights to the property. The heirs, including his wife and 4 children from the previous marriage, can file an affidavit of heirship and transfer the property in their name. Then the wife can claim her share in the property.
Feel free to ask if you've further queries.

So my stepmother will get equal share for the house in Nevada?
Hi Nikki,
Your step mother will be able claim an equal share from the property of your father.
Thanks
