Do I have to pay taxes when a quit claim deed is filed?

I am going through the confusing process of filling out several forms to remove my ex-husband's name from the deed to our house. We are both listed on the current deed. He has agreed to sign the necessary forms and remove his name from the deed. When the papers are filed do I need to pay taxes on the house? I already pay taxes yearly through my escrow and paid taxes when we bought the house.

And why would I have to pay taxes when I am not selling or buying the house...I am already co-owner and it's simply removing his name from the deed. Taxes already pay through my mortgage every month with the escrow account....that seems ludicrous to be paying double taxes when they were already paid....

Hi salleycat,

Though you are not selling or buying the property, a property transfer is taking place. Thus, you would be liable for property transfer fees, stamp doc fees, etc. You can contact your ex-husband and both of you can share these taxes amongst yourselves.

Hi Salleycat,

As per my knowledge you are liable to pay the property taxes even after quitclaim. You can discuss with your ex-husband to share the taxes but if he denies then you have to pay the taxes. If you buy, sale or transfer a property then you have to pay the taxes and stamp document fees. Consult with a good attorney and check out all the options.
