my ex-husband and i own a home (second) in florida tht has gone into forclosure. it is up for a sheriff's sale in a few months. we can not deal with each other on anything yet owe tons of money on this property. if he is willing, can i quit claim deed the home to my ex so he has rights to try to negotiate on his own with the mortgage company? how about novation? i do not want to get involved with a short sale or anything with him. can either of these things be done at this point to give him the power to negotiate?

you can quit claim your share of the property to your ex-husband. this will make him the sole owner of the property. he will be able to deal with the lender regarding the sale of the property. however, your name will not be removed from the mortgage. your ex-husband will have to refinance or go for a novation to transfer the mortgage in his name.
