Should I sign a quitclaim before I get my money?

Posted on: 16th Oct, 2009 09:16 am
I am being asked to sign a quitclaim deed for property before I receive my money for the property. There is a divorce settlement stating the amount my x owes me, but those dates have already passed by. He is refinancing to get my money but the mortgage company wants me to sign the quitclaim deed then wait to get my check. Shouldn't I get my money and sign the quitclaim at the same time?

Also, should the quitclaim deed list an amount of $1.00 or the amount that he will pay to me for my part of the property?
you got it right terrilynn - the timing should be coincidental. at the same time you are being given your remuneration you would hand over your quit claim deed.

your divorce lawyer(s) should have arranged for timely transition and advised both of you how it ought to be handled. shame on them.
