If a property was abandon by someone how can that person be removed from a quitclaim deed

Posted on: 20th Mar, 2009 08:59 am
I'm a property owner who moved to a smaller apartment and quitclaimed my property to one of my daughters after living there for 18 years out of angry she decided to move and abandon the property and took the stove, the ac unit, light, closet doors , washer and dryer but to make a long story short i will like to move back into my house and remove her from the quitclaim deed and quitclaim it to someone else.
Hi ber,

It is not quite possible to remove someone from the deed, unless he/she agrees to sign a quitclaim deed to give up his/her interest in the property. However, if you think your daughter will never come back to live in the property or claim an interest in it in future, you can file a quiet title lawsuit in court with the help of an attorney. If the court is convinced there is no claim on the property, it will pass an order making you the sole owner of it.

Thanks,

Jerry

As the property owner, I have a foreclosed mobile home on my property which space/lot has been rented. The tennants chose foreclosure and moved. As a result, the foreclosure was begun, which upon vacating and abonding the mobile home. Thus leaving the mobile home vacant since l June 09. Beginning 1 July 09 to present; shouldn't the Mortage holder be obligated to pay a reasonable lot rent to the owner as long as the mobile home is on the premisis?

My landlord passed in Sept. 10 and his estate is left in the hands of charity. In the park where I reside there are at least 30 homes that he owns but only six were still occuiped.

I have continued to pay the fees to the park for the home being there but the other empty homes have been taken over by the park how could this effect me in the end? And if there is no legal owner then what should I do next?
Thanks In Advance,
Shawanka

Hi Shawanka!

Welcome to forums!

The estate has been left in the hands of the charity. The charity organization will decide what they will do in this regard. You can speak to the charity organization and the park authorities in this regard.

Feel free to ask if you've further queries.
