my mom passed and she owned a house since 1978 she got married in 1991 and she passed in 2009 the husband does not want to have any thing to do with the property can i get the house quit claim the property in my name

As your mother is deceased, you cannot get the property quit claimed in your name. You will have to contact the county recorder's office and file an affidavit of heirship. This will help you in transferring the property in your name.

Hi,

Sussane is right, as your mom passed away, the quit claim will not help. Quitclaim only helps when a person who is alive wants to transfer or quit any interest in real property. If there is no will and your mom is the owner of the property then as a legal heir you have the right to that property. However, you need to consult with an attorney and contact the county recorder's office to transfer the property in your name.
