If my mother in law fills out a quick claim deed transfering the property to my wife and her sister but it isnt filed until after her death, is it still valid?
Hi gusclint,
Welcome to mortgage fit,
Basically it is not a 'quick claim' rather it is a 'quitclaim'.and even if you file it at this moment it is not valid...So instead you should submit the death certificate of your mother to county office and then all the successors will receive their share.
If your mother has done any sort of will then all the distribution will be done as per the will whereas in absence of will the property will be distributed to the family members.
Feel free to ask any further query if you have...............
