MY DAD PASSED AWAY LEAVING NO WILL ALL SISTERS AND BROTHERS ARE SIGNING HEIRSHIP PAPERS TO GIVE ME THE HOUSE I WANT TO GET HOUSE IN MY NAME SO I CAN FILE FOR EXEMPTIONS. I DOWNLOADED A QUIT CLAIM FORM AND HAVE THE DEED. ON THIS FORM IT DOESN'T ASK ANY QUESTIONS ABOUT THE PROPERTY. THE HEIRSHIP PAPERS DO. ALL SISTERS AND BROTHERS ARE SIGNING THEIR DOCUMENTS BEFORE A NOTARY. DO I SIGN HEIRSHIP PAPERS AND QUIT CLAIM FORMS ALSO? OR DO I NEED A QUIT CLAIM FORM WITH MORE DETAILS. THANKS

You should contact a real estate attorney and discuss your case with him. He will help you in drafting the quitclaim deed so that you can get the property transferred in your name.

Thanks you for writing back but I do not have funds for attorney. we're doing it ourselves. the forms are available at Staples and the paperwork has to be filed by December 31rst to avoid next years taxes. I do need to know if their is a lien on house will we be able to transfer title? Thanks again

The format for quitclaim deeds vary. Some states require two witnesses and some do not. Take a trip to you local recorder's office or clerk of court where they record deeds. Take a look at some recently filed quitclaim deeds that were prepared by an attorney. You can buy a copy of one because they are public records and use the same format as the one at the courthouse. You will also want to check with the clerk or the property appraiser office for the "legal description" of the property. That has to be listed on the deed not the physical address. Also ask the clerk about margins and spacing on the document. Because everything is scanned into a computer now some clerks have requirement on the margins on the paper. Also to get a homestead exemption the property has to be your primary place of residence. You will probably need a government issued photo id, vehicle registration, voter's registration card, etc to prove it. Find out what you need so you can get it before Jan 1st.
