How do I get my name on a Deed of a Deceased friend who has adult children...My friend died and left 2 adult children who did not want the property and gave it to me (she had only just purchased it 7 months before her death) I have stayed in the house and am making the last payment next month on a 15 year mortgage. I continued to pay under her name because the rate was very low. All taxes and improvements, repairs have been paid by me. (My friends children live in another state and she left no will). What can we do to get the deed put in my name. Can they "QuitClaim" it to me? And with the deed being in their deceased mother's name, do they have to file an "affidavit of heirship" before it is legal for them to do so? Can all this be done without probate?

Though the owner of the property is deceased, quitclaim can be filed but for that you will have to take legal help. If the children file an "affidavit of heirship" then they can directly quitclaim the property in your name. Yes, I think this can be done without any probate.

The children can file affidavit of heirship and when the property is in their name, they can file a quitclaim deed in your name and add your name to the title of the property.
