my husband cheated twice in one year and he agreed to let me have the fl home however he is the only...one on the note. i am thinking since we are just seperating that maybe he can sign over the quit claim deed over to me and i would agree to pay the note that is only in his name that is if he does not change his mind. would that quit claim deed allow me to have the home prior to the divorce and at the divorce can it be challenge for him to get money
Yes, the quitclaim deed may allow you to have the home. But let's not forget the lender. I mean if the lender comes to know of a property transfer, chances are he may call the loan due. However, you need to check out what's mentioned in the loan doc about any change in property ownership.
