Quit Claim deed

Posted on: 28th Sep, 2009 02:28 pm
my ex husband and i have been divorced for 15 years. i have lived in the house that we owned together (in both of our names) for all of that time and made all of the mortgage payments, until recently when i paid it off in full. he has since bought another property, but has lost his job and may not be able to make his mortgage payments. i'm afraid that if he walks away from his property, the bank will come after his share of my home. will filing a quit claim deed prevent this from happeing? is there anything else i should do to protect my home?
Hi Gayle!

Welcome to forums!

You can ask your husband to sign a quitclaim deed in your favor. Once he transfers the property to you, it will be considered as your property. You'll be the sole owner of the property and his creditors will not be able to come after your property. As the mortgage has been paid in full, you do not require to do anything else.

Feel free to ask if you've further queries.
