can i do a quick deed if my husband is sent to prison for 10 years

Posted on: 26th Jun, 2010 01:18 pm
i have been married for six years , after two years my new husband as arrested on charges from his past
I have waited and tried to keep things going in our home
yet times have gotten very hard , I would like to get a mortgage on our home ,yet my name is not on the title
or the deed . would it be in my rights to get a quick deed
our property ? my husband dos'nt want me to do this because he don't think that times are as bad as they are right now.
my husband is 67 years old and has 6 years left to go
in prison, i only want to save our home ,he just dont understand he's set in his ways , whats my rights ?
Hi dslimk,

As your name is not on the property deed, you do not have ownership rights over that property. If you want to add your name to the property deed, then your husband needs to sign a quit claim deed in your favor.

Thanks
