I quit claimed house to ex, but only I am on the mortgage. I want to have her quit claim it back to me, and she has agreed because the house is going into foreclosure and the bank has permitted me to begin short sale process. can this be done during this period?

Before taking any further step in this regard, you should immediately have a word with a real estate attorney and your lender. If both of them agree to the quitclaim deed thing, then you can go ahead with it.

I agree with what James has said. A quitclaim deed may be signed but as the property is in foreclosure, it will be better to take the opinion of the lender prior to getting the property transferred in your name.
