Can I sign a quit claim deed?

Posted on: 11th Sep, 2008 02:12 pm
I am getting a divorce. My mom owns a house and my name is on the title. We do not want her house to become a part of the divorce settlement. She wants to take my name off the title and ask another brother to add his name in the event of something happening. What is the best possible way to approach this?
Hello- A quit claim will probably be the best way to accomplish. Doublecheck with a Real Estate Attorney in your area to be safe, given your situation.

A quit claim would work, but if you're already in the middle of a divorce the court may see it as you are trying to hide assets. Just be aware and discuss with your attorney.

I agree, a quit claim will accomplish this. You can have this prepared by a local title company or attorney.
