i live in tn. my husband moved out > 2 yrs ago and has never made a mortgage payment in 10 yrs we liveed in house together. i made all the payments. can i file a quit claim deed?

If title of property is clear & debt free then you can file quit claim deed. If your husbands name mentioned on deed...his agreement is must for Quitclaim Property.

yes you can file a quit claim deed. however, a quit claim deed does not change the original name on the mortgage note; i have said this time and time again. you can file a quit claim deed and be on the deed, yet you are not on the mortgage note itself. if you are not on the note there is no certain way to make sure that you are getting credit for any mortgage payments you will be making, and some lenders will not even talk to you if your name is on the deed of trust but not on the mortgage note. so doing a quit claim may not be the best choice to get the mortgage in your name, you will need to outright buy the home, refinance it into your name, or obtain financing with a bank in order to buy it. i don't mean to be the bearer of bad news, but sometimes you are just better off buying the property and putting it in only your name if you are able to do so.
