Quitclaim Deed to husband to refinance

Posted on: 20th Feb, 2009 12:16 pm
we recently went to refinance our home to get some money to pay off credit cards but we were turned down because of my bad credit score. i had too much credit card debt. my husband suggested that we get it financed in his name only so i agreed. he then came to me with a quitclaim deed from his lawyer to sign so we could go on with the loan. i did not want to sign the quitclaim deed because i knew it would be signing my rights to the property away. he insisted and said that i could trust him and that the next day he would sign a quitclaim deed to put my name back on the deed. two days later he did come home with a legitimite looking quitclaim deed with him as the grantor and me as joint tenant with the right of survivorship. we live in ga. is this legal and how can i go about making sure that my rights to our house are still in tack? how can i make sure that this will be filed and is not just a phoney quitclaim deed? it does have a notarized stamp on it.
I don't know about all that you don't have to "sign your property away". You just need to get a quitclaim deed to ADD his name on and yes it has to be registered to be legal.

Hi vjthompson,

Since the deed bears the stamp of a nomary public I think it's a valid one. In case he's using an illegitimate deed, the transfer can be proved to be invalid and void in the court and the deed can be reversed in future. However, before you sign you can get it in writing from him that he'll refinance the home as soon as the deed is signed over to him. Otherwise you'll be left to pay off the credit card debts without having your name on the title to the home.

Thanks,

Jerry
