CAN MY HSUBAND AND I FILE A QUITDEED TO CHANGE OUR DEED TO JOINT TENANTS, AS IT IS FILED AS TENANTS IN COMMON NOW AT THE LOCAL COURT HOUSE. WE OWN THE HOME OUTRIGHT AND MY UNDERSTANDING IS THE JOINT TENATS, THE HOUSE WOULD GO TO THE SURVIVING MEMBER. IS THAT CORRECT AND THANK YOU IN AVDANCE FOR YOU ANSWER.
Hi DUANE,

Welcome to the forum.

You rightly understood that in Joint tenancy if one tenant dies the other will automatically get the ownership. But I think Survivorship Deeds is the best way to achieve joint tenancy. So better use a Survivorship Deed.

Feel free to ask if you have any further questions.

Best of luck,
Larry

DUANE, USING ALL CAPITAL LETTERS IS CONSIDERED RUDE!

The answer to your question, is, Yes, with joint tenancy, the surviving joint tenant takes title to the property.
