Quit Claim Deed

Posted on: 05th Jan, 2010 05:03 am
i purchased a home on a land contract a few years ago. the sole owner passed away recently leaving no will. before he passed he signed a quit claim deed to his good friend to this property. he wanted the to repay this friend for all the time she helped him. the friend also had power of attorney at the time he signed the deed. it has not been notorized or filed. everything to my understanding is now in probate except this property as there is the contract on the property. we make the payments to the bank which go into a account he set up with his friends name on as ownership. the family is furious & i believe they are going to cause problems. is the deed legal? if not do we continue to make payments as it has been stated the will force us to refinance or evict us if we do not. refinancing is not possible for us at this time.
Hi Cindy,

I would suggest you to contact an attorney and take his opinion in this regard. If you've signed a contract with the original owner, the the contract stands valid and the family members can't declare it void. Your attorney will help you know what steps you need to take in this regard.
