Hi, I am in a divorce after 26 years of marriage. We built on his father's land and pay taxes on house and well only. His father had me to have it servery about 5 years ago into our names. I have a copy but his dad still has the original.

The kids and I have lived here for 9 years and the last year my husband has not been here but a few days at Christmas. He walked out and abandoned me and the kids no income or help at all for 3+ months and not much the last 12. Does not talk to any of us.The house is paid for. I was a stay at home mom.

My lawyer seems to be dragging it out and not having the right paper work completed by court dates. I guess my question is will I have to leave my home? We have another property about an hour and half away that we have used as rental property. He has not done repairs and up keep and it is in bad shape. the last renters left it even worse! He has always expected me to go in and clean and repair the best I could. with what little money he gave.

I have not had the money to do it this time. And he took control of it about 18 months or so ago so I could not get the rent off of it. there is a mortgage on it in his name, but he stays a couple of months due all the time. Even though he makes 6 figures! He is having fun living at the beach and not having any responsibilities except his job.

He is an alcoholic and always has been it is just worse since a doctor put him on antidepressants. Our daughter had to change her college so we could try and afford it through pell grant (1st year). how does a person just say hey I don't have a family anymore? I have had 3 surgeries this year and will never have full use of my left hand again. Was he there? Nope!

Thanks
Hi wnhowell!

Welcome to forums!

If your name is included in the property deed as one of the owners, then you won't have to leave the property. As one of the owners of the property, you've full rights to stay in it. No one can ask you to leave the property.

Feel free to ask if you've further queries.
